These Terms of Service ("Terms") govern your use of the QwikGlam app and website (the "Platform"). QwikGlam is operated as a sole proprietorship based in Bengaluru, Karnataka, India (Proprietor: [PROPRIETOR LEGAL NAME]; Udyam Reg. [UDYAM NO.]; GSTIN [GSTIN]). By using the Platform you agree to these Terms and to our Privacy Policy.
You must be at least 18 years old and able to form a legally binding contract to use QwikGlam. By creating an account you confirm that the information you provide is accurate and that you accept these Terms. If you use the Platform on behalf of someone else, you confirm you are authorised to do so.
QwikGlam is a technology marketplace that connects customers with independent, third-party beauty professionals ("Artists") who offer at-home beauty services. QwikGlam does not itself provide beauty services. The Artist — not QwikGlam — performs the service you book, and the service contract for that work is between you and the Artist.
When you place a booking, QwikGlam attempts to match you with a suitable nearby Artist. Matching depends on availability, location, and other factors, and we do not guarantee that an Artist will be available for any given time or place. If no Artist accepts, we will tell you and any amount charged will be refunded as described in our Refund Policy.
Estimated arrival times and service durations are estimates, not guarantees. You agree to provide a safe, lawful, and reasonable environment for the Artist to perform the service.
Cancellations are governed by our Cancellation Policy and refunds by our Refund Policy, which form part of these Terms. In short: cancellations made early are fully refundable, while later cancellations may carry a charge that fairly compensates the Artist for time and travel.
Artists are independent contractors, not employees or agents of QwikGlam. Artists are responsible for the manner, quality, and safety of the services they provide and for their own tax and regulatory compliance. If you are an Artist, your relationship with QwikGlam is additionally governed by the Artist Agreement.
You may submit ratings, reviews, photos, and other content. You are responsible for what you submit, and you must not post anything unlawful, defamatory, infringing, or misleading. By submitting content you grant QwikGlam a non-exclusive, royalty-free licence to host, display, and use it to operate and promote the Platform. We may moderate or remove content that violates these Terms.
The QwikGlam name, logo, app, website, and content are owned by QwikGlam and protected by law. You may use the Platform only for its intended purpose and may not copy, modify, or create derivative works without our written permission.
The Platform is provided on an "as available" basis. Because services are performed by independent Artists, QwikGlam does not warrant any particular outcome of a service. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including your rights under the Consumer Protection Act, 2019.
Subject to the above, and to the maximum extent permitted by law, QwikGlam's total liability arising out of any booking is limited to the amount you paid for that specific booking. QwikGlam is not liable for indirect or consequential losses. If you experience an issue with a service, please use our support and dispute process so we can help resolve it fairly.
You agree to indemnify QwikGlam against claims, losses, and expenses arising from your breach of these Terms, your misuse of the Platform, or your unlawful conduct toward an Artist or other person.
We may suspend or terminate your access if you breach these Terms, misuse the Platform, or pose a risk to Artists or other users. You may stop using the Platform and delete your account at any time (see our Privacy Policy and account deletion page).
These Terms are governed by the laws of India. Subject to applicable consumer-protection law (which may allow you to bring a complaint where you reside), the courts at Bengaluru, Karnataka shall have jurisdiction. We encourage you to first raise any concern with our Grievance Officer so we can resolve it quickly.
We may update these Terms from time to time. For significant changes we will give notice via the app, email, or our website before they take effect, and we will update the "Last updated" date. Continued use after changes means you accept the updated Terms.
