This Artist Agreement ("Agreement") sets the terms on which an independent beauty professional ("you" or "Artist") offers services through the QwikGlam platform. QwikGlam is operated as a sole proprietorship in Bengaluru, Karnataka, India (Proprietor: [PROPRIETOR LEGAL NAME]; Udyam [UDYAM NO.]; GSTIN [GSTIN]). By registering as an Artist and accepting this Agreement, you agree to these terms together with our Terms of Service and Privacy Policy.
1. Independent Contractor — Not an Employee
You are an independent contractor. Nothing in this Agreement creates an employment, partnership, agency, or joint-venture relationship. You decide when you are available and which bookings to accept, you use your own tools and products, and you are responsible for the manner and quality of your work. You are not entitled to employee benefits, and you are responsible for your own taxes, licences, and statutory registrations.
2. Eligibility & Verification (KYC)
- You must be at least 18 and legally permitted to provide beauty services in India.
- You must provide accurate verification documents — a valid government photo ID, PAN, a verification selfie, and your payout bank/UPI details. These are stored securely and used only for verification, payouts, safety, and legal compliance.
- You confirm you have the skills, training, and any hygiene or health clearances appropriate to the services you offer.
- QwikGlam may re-verify your details at any time and may withhold dispatch or payouts if verification is incomplete or inaccurate.
3. Bookings & Dispatch
- When a customer books, QwikGlam may offer the job to you based on factors such as proximity, ratings, and availability. You may accept or decline within the acceptance window shown in the app.
- If you accept, you commit to arriving on time and performing the booked service professionally. Repeated late acceptance, no-shows, or last-minute cancellations harm customers and may affect your standing on the Platform.
- You will perform only the services you are qualified for and that are booked through the Platform.
4. Earnings, Commission & Payouts
- Commission & split: QwikGlam retains a platform commission of 10% of the service base price, and you receive 90%. QwikGlam may revise the commission rate prospectively on reasonable prior notice; the rate applicable to a booking is the rate shown to you at the time you accept it.
- Tips paid by customers belong entirely to you and are passed through without commission.
- Travel compensation may apply where a customer cancels after you are en route, as set out in the Cancellation Policy.
- Payouts are made to your registered bank account or UPI through our payment partner after the booking is completed and confirmed and any verification/dispute window has passed, normally within [X business days / on a weekly cycle].
- Taxes: as an e-commerce operator, QwikGlam may be required to deduct tax at source (TDS) on the gross amount of your services under applicable law (e.g., Section 194-O) and to report it. You are responsible for your own income tax and any GST obligations. Provide a valid PAN to avoid higher withholding.
5. Professional Conduct & Customer Safety
- Act professionally, punctually, and hygienically. Use clean, safe, and compliant products and equipment.
- Respect every customer's home, privacy, and safety. Harassment, discrimination, intoxication, theft, or any unsafe or unlawful behaviour is strictly prohibited and may lead to immediate removal and reporting to authorities.
- Do not photograph, record, or contact a customer outside the booking without their clear consent.
- Follow QwikGlam's safety guidelines and report any incident promptly through the app.
6. No Off-Platform Dealing
For customers introduced to you through QwikGlam, you agree not to solicit or arrange services outside the Platform to avoid commission. Doing so is a material breach and may result in removal.
7. Customer Data & Privacy
You will receive only the customer information needed to perform a booking (such as name, service address, and booking details). Calls are connected through a masked-calling service, so you will not receive the customer's phone number. You must use customer data only to provide the booked service, keep it confidential, and not store, share, or reuse it for any other purpose. This obligation continues after this Agreement ends.
8. Ratings, Quality & Standing
Customers rate your service. QwikGlam may use ratings, completion rates, cancellation rates, and complaints to determine your visibility and dispatch priority. Consistently low ratings or repeated complaints may lead to coaching, temporary suspension, or removal.
9. Suspension & Termination
- QwikGlam may suspend or deactivate your account for breach of this Agreement, safety or fraud concerns, repeated cancellations or no-shows, failed verification, off-platform dealing, or unlawful conduct.
- You may stop offering services and request account closure at any time.
- On termination, any earnings validly due to you for completed, undisputed bookings will be paid out in the normal course, subject to lawful deductions.
10. Liability & Indemnity
You are responsible for the services you perform and for any harm, loss, or claim arising from them. You agree to indemnify QwikGlam against claims arising from your services, your conduct, or your breach of this Agreement. QwikGlam is an intermediary platform and does not assume the Artist's professional liability. You are encouraged to maintain appropriate insurance for your work.
11. Changes to This Agreement
We may update this Agreement from time to time. We will notify you of significant changes through the app or email before they take effect. Continuing to accept bookings after a change means you accept the updated Agreement.
12. Governing Law
This Agreement is governed by the laws of India, and the courts at Bengaluru, Karnataka shall have jurisdiction, without affecting any mandatory rights you have under applicable law.
Acceptance: By ticking "I have read and agree to the Artist Agreement" during onboarding, you accept these terms. QwikGlam records your acceptance (your Artist ID, the Agreement version, and the date/time) for compliance purposes.
